Abbas Law achieves I-829 Approval following Mandamus Lawsuit
Abbas Law PLLC achieved a long-awaited Form I-829 petition approval for an EB-5 client this month. Unfortunately, due to unreasonable delay by USCIS, this family had to wait for over four years to receive this approval – and USCIS refused to act until prompted by a federal mandamus lawsuit regarding the delay. Ms. Abbas was elated to help this family finally reach un-conditional permanent residency, the ultimate goal of the EB-5 immigration program.

The U.S. Congress has re-authorized the EB-5 Regional Center program for the next 5 years, through September 30, 2027. President Biden will likely sign the bill officially into law today. Once the law is officially on the books, USCIS and the U.S. Department of State will begin to process pending EB-5 cases and EB-5 Visa applications that were put on hold during the lapse.
Developments in EB-5 Required Investment & Regional Center Program
This is a unique time for the EB-5 Immigrant Investor Program as two major developments have taken place in June 2021. The minimum required investment to apply for the program has changed. Also, the Regional Center program has expired. The most likely scenario is that these are temporary adjustments, however, and will not be in place for the long term.
Long-Awaited EB-5 Rule Change Published Today
Today, the U.S. Citizenship & Immigration Service (USCIS) has published the Final Rule containing new regulations for the EB-5 Immigrant Investor Program. This is the first significant amendment to the program since it was first codified in 1993. The Final Rule will go into effect on November 21, 2019.

EB-5 Program Extended until September 30, 2019
Once again, the EB-5 Program has survived for a few more months, until September 30, 2019. At the moment, the program will continue without any changes, so the investment minimums of $1,000,000 (non-Targeted Employment Area) and $500,000 (Targeted Employment Areas) still stand. However, there is a very high likelihood that these amounts will be increased, and that other changes may be implemented, in the near future.
